REFUND & CANCELLATION POLICY

1. ABOUT THIS POLICY
This Refund & Cancellation Policy explains the circumstances in which Birmingham Remap may provide refunds, cancellations, or other remedies in relation to our vehicle software, ECU remapping, diagnostics, programming, coding, cloning and related services.
Our Services may involve the creation, modification, installation, supply or programming of vehicle software and digital files. Once certain services have been performed or digital content has been supplied, they may not be capable of being returned in the same way as ordinary physical goods.
Nothing in this policy is intended to remove or restrict any statutory rights or remedies you may have under UK consumer law.
2. SOFTWARE AND DIGITAL SERVICES
Software supplied, created, modified or programmed by Birmingham Remap is non-returnable once the service has been completed or the software/digital content has been supplied, subject to your statutory rights.
Because ECU software and digital files can be supplied electronically, downloaded, installed, transferred or programmed directly into a vehicle, they cannot generally be returned in the same manner as physical products.
Accordingly, we do not provide discretionary refunds simply because a customer changes their mind after:

ECU remapping has been completed;

Software has been supplied;
-
A modified calibration/file has been supplied;
-
Software has been installed or programmed;
-
An ECU, TCU or module has been programmed;
-
An ECU or module has been cloned;
-
A vehicle has received a software modification; or
-
The customer subsequently decides that they no longer want the modification.
This does not affect any legal rights you may have where a service has not been provided with reasonable care and skill, where digital content does not conform to applicable legal requirements, or where another statutory remedy applies.
3. ECU REMAPPING SERVICES
Once an ECU remapping service has been completed, we do not offer a refund simply because:

You are unhappy with the performance increase;

You expected a different performance result;
-
You expected a particular horsepower or torque figure that was not expressly guaranteed;
-
You have changed your mind;
-
You no longer want the remap;
-
You have sold or intend to sell the Vehicle;
-
Your insurance provider will not cover the modification;
-
You did not inform your insurer of the modification;
-
You subsequently decide not to use the Vehicle; or
-
You simply no longer require the service.
Where you believe there is a genuine problem with the service, you should contact Birmingham Remap so that we can investigate the issue.
Nothing in this section affects your statutory consumer rights.
4. DIAGNOSTIC SERVICES
Diagnostic services are generally non-refundable once the diagnostic work has been carried out.
A diagnostic service involves the use of specialist equipment, software and technician time to inspect and assess a Vehicle.
We do not guarantee that a diagnostic scan will identify every fault or establish the precise cause of a vehicle problem.
If you believe that a diagnostic service has not been carried out with reasonable care and skill, please contact us so that we can investigate.
5. ECU, TCU AND MODULE PROGRAMMING
Programming, coding and cloning services are non-refundable once the requested service has been successfully completed, subject to applicable statutory rights.
This includes, where applicable:

ECU programming;
-
ECU cloning;
-
TCU programming;
-
TCU cloning;
-
Module programming;
-
Module coding;
-
Software installation;
-
Software modification; and
-
Other electronic control module services.
If programming or cloning is unsuccessful because of a defective, damaged, corrupted or otherwise unsuitable module, we will assess the circumstances and discuss the available options with you.
6. FAILED OR UNSUCCESSFUL SERVICES
Where we are unable to complete a service, we will assess the circumstances on a case-by-case basis.
For example, a service may be unsuccessful because:

The ECU or module is defective;

The Vehicle has an existing electrical or mechanical fault;
-
The ECU/TCU cannot communicate correctly;
-
The Vehicle has previously been modified;
-
The software is corrupted;
-
The Vehicle has insufficient or unstable battery voltage;
-
The manufacturer has introduced a software/security restriction;
-
Required third-party systems are unavailable; or
-
The requested service is technically unsuitable.
Where appropriate, we may offer:
-
Further diagnostic investigation;
-
An alternative solution;
-
Restoration of the original software where technically possible;
-
A replacement appointment; or
-
A refund where we are legally required to provide one.
We will assess each case based on the individual circumstances.
7. CUSTOMER CHANGE OF MIND
If you change your mind after a service has been completed or digital software has been supplied, we do not provide a discretionary refund solely because you no longer want the service.
For example, a refund will not normally be provided solely because:

You expected different results;
-
You changed your mind;
-
You purchased the service in error;
-
You no longer own the Vehicle;
-
You no longer wish to modify the Vehicle; or
-
Another person has advised you not to proceed.
Your statutory rights remain unaffected.
8. CANCELLATION BEFORE WORK BEGINS
If you need to cancel an appointment, please contact Birmingham Remap as soon as possible.
Where work has not yet started, we will consider cancellation requests in accordance with applicable law and the circumstances of the booking.
If you cancel sufficiently before an appointment, we will normally attempt to reschedule the appointment or process any refund that is legally due.
Where a service has already begun at your express request, different cancellation rules may apply.
9. SERVICES STARTED BEFORE THE CANCELLATION PERIOD EXPIRES
Where you are a consumer and a statutory cancellation period applies, you may request that we begin providing the service before that cancellation period has expired.
Where applicable, we will obtain the necessary confirmation from you before beginning the service.
If you expressly request that a service begins during the cancellation period, you may be required to pay for the proportion of the service already supplied if you subsequently exercise a cancellation right, where permitted by law.
Where the service has been fully performed following your express request and the required acknowledgement has been provided, your statutory right to cancel may no longer apply.
10. DIGITAL CONTENT
Where Birmingham Remap supplies digital content that is not supplied on a physical medium, you may have statutory cancellation rights depending on the circumstances.
If you expressly request that digital content is supplied or made available before the end of a cancellation period, we may be required to obtain your confirmation that you understand that this may affect your cancellation rights.
Once digital content has been supplied following the necessary consent and acknowledgement, we may not be required to provide a cancellation refund where permitted by law.
Nothing in this section affects statutory rights relating to defective or non-conforming digital content.
11. SOFTWARE PERFORMANCE
We do not offer refunds solely because software performance does not meet a customer's subjective expectations.
Performance can vary between vehicles due to factors including:

Engine condition;
-
Vehicle mileage;
-
ECU condition;
-
Fuel quality;
-
Existing modifications;
-
Mechanical condition;
-
Maintenance history;
-
Vehicle specification;
-
Transmission condition; and
-
Manufacturer tolerances.
Any advertised performance figures are indicative unless a specific performance figure has been expressly guaranteed in writing.
12. VEHICLE FAULTS
Birmingham Remap is not responsible for pre-existing mechanical or electrical faults.
A vehicle may develop a mechanical or electrical problem after a software modification that is unrelated to the work performed by us.
Where you believe a fault has resulted from our Services, please contact us before arranging unrelated repairs where reasonably possible so that we have an opportunity to inspect and investigate the matter.
This does not prevent you from exercising any statutory rights or obtaining necessary emergency repairs.
13. EMISSIONS-RELATED SERVICES
Where legally permitted and appropriate, Birmingham Remap may receive enquiries relating to vehicle emissions systems.
Certain modifications to emissions-control systems may be unlawful for use on public roads.
We do not provide refunds on the basis that a customer subsequently discovers that a requested emissions-related modification is unsuitable or unlawful for their intended use where the relevant information was available or the customer was responsible for determining the Vehicle's intended lawful use.
Nothing in this section limits any statutory consumer rights.
14. INCORRECT CUSTOMER INFORMATION
We are not responsible for losses arising from incorrect or incomplete information supplied by the Customer, except where applicable law provides otherwise.
This may include providing:

Incorrect vehicle registration;

Incorrect VIN;
-
Incorrect ECU information;
-
Incorrect vehicle model;
-
Incorrect engine information;
-
Incorrect software information; or
-
Incorrect technical information.
Where incorrect information results in additional work being required, additional charges may apply where permitted by law.
15. PHYSICAL PRODUCTS
If Birmingham Remap sells any physical products through the website in the future, those products may be subject to separate return and refund terms.
Any statutory consumer rights relating to physical goods will continue to apply.
Unless otherwise stated, physical products must be returned in accordance with the instructions provided by Birmingham Remap.
16. FAULTY SERVICES AND STATUTORY RIGHTS
If you believe that a service has not been provided with reasonable care and skill, or that digital content supplied by us does not meet applicable legal requirements, please contact us.
Depending on the circumstances, you may have statutory rights to require us to:

Repeat the service;

Repair or correct the issue;
-
Provide an appropriate price reduction; or
-
Provide another remedy available under applicable law.
We will assess the circumstances and respond accordingly.
17. HOW TO REQUEST ASSISTANCE
If you believe there is a problem with a service, contact us as soon as reasonably possible.
Please provide:

Service purchased;

Order or booking reference, if available;

Description of the issue; and

Any relevant photographs, diagnostic information or other evidence.

18. REFUND PROCESS
Where Birmingham Remap agrees that a refund is due, or where a refund is required by law, the refund will normally be made using the original payment method.
We will process approved refunds within the timeframe required by applicable law.
The time taken for funds to appear in your account may depend on your bank or payment provider.
19. CHARGEBACKS
If you believe a payment has been taken incorrectly, please contact Birmingham Remap before initiating a payment dispute where reasonably possible.
We will investigate genuine payment disputes and attempt to resolve them fairly.
Nothing in this section restricts your statutory rights or your ability to contact your payment provider.
20. NO GENERAL "30-DAY RETURN" POLICY
Birmingham Remap does not operate a general 30-day return policy for ECU software, ECU remapping, diagnostics, programming, coding, cloning or other completed vehicle software services.
These services are different from ordinary physical retail goods because they may involve bespoke software, digital files, technician time and direct programming of a customer's vehicle.
Any cancellation, refund or remedy will therefore be handled in accordance with this policy and applicable UK consumer law.
21. CHANGES TO THIS POLICY
We may update this Refund & Cancellation Policy from time to time.
The latest version will always be published on this page.
Any changes will take effect from the date stated at the top of the updated policy.
