1. ABOUT THESE TERMS
Welcome to Birmingham Remap.
These Terms & Conditions ("Terms") govern your use of our website, the purchase of our products and services, and any services we provide to you, including mobile ECU remapping, vehicle diagnostics, ECU and TCU services, programming, coding and related vehicle software services.
In these Terms:

"Birmingham Remap", "we", "us" or "our" means Birmingham Remap.

"Customer", "you" or "your" means the person purchasing or requesting our products or services.

"Vehicle" means the car, van or other vehicle presented to us for inspection, diagnosis, programming, coding, remapping or other work.

"Services" means the vehicle-related services offered by Birmingham Remap through our website, by telephone, electronically or in person.
Our website is operated using Shopify's platform.
By accessing our website, requesting a quotation, making a booking, placing an order or using our Services, you agree to these Terms together with any other policies referred to on our website.
If you do not agree with these Terms, please do not use our website or purchase our Services.
Nothing in these Terms is intended to exclude or restrict any statutory rights you have under applicable UK consumer law.

Services may be provided at our premises, at the customer's home or workplace, or at another agreed location where our mobile service is available.
The exact service provided will depend on the vehicle, ECU/TCU/module, software version, vehicle condition and the customer's requirements.
We reserve the right to refuse or decline a job where we reasonably believe that carrying out the requested work would be unsafe, unlawful, technically unsuitable or likely to cause damage to the vehicle or its components.
3. VEHICLE SOFTWARE MODIFICATIONS
ECU remapping and other software modifications can alter the operation, performance and characteristics of a vehicle.
The results of a remap can vary depending on:

Existing faults
-
Previous modifications
-
Vehicle maintenance

Fuel quality

Mechanical condition

Manufacturer software and hardware

Individual vehicle tolerances
We do not guarantee a specific horsepower, torque, fuel economy or performance increase unless a specific result has been expressly agreed in writing.
Performance figures displayed on our website, advertisements or other marketing materials are indicative only unless expressly stated otherwise.
4. VEHICLE CONDITION AND PRE-EXISTING FAULTS
You must inform us before work begins of any known mechanical, electrical, diagnostic or software faults affecting the Vehicle.
This includes, but is not limited to:

Warning lights

Engine management faults
-
Previous ECU modifications
-
Previous remapping
-
Previous tuning
-
Faulty ECUs
-
Faulty sensors
-
Battery or charging problems
-
Turbocharger issues
-
Fuel-system problems
-
Transmission problems

Existing mechanical faults
We are not responsible for faults that were present before our work commenced.
A software modification may expose or increase the symptoms of an existing mechanical or electrical fault. This does not necessarily mean that the software modification caused the underlying fault.
Where we identify a condition that makes the requested work unsuitable or unsafe, we may decline to proceed.
5. DIAGNOSTICS
Diagnostic services are intended to identify or assist in identifying potential faults.
A diagnostic scan does not necessarily identify every fault with a vehicle.
A diagnostic fault code is not, by itself, confirmation that a particular component is defective.
Further testing, inspection or mechanical diagnosis may be required.
We do not guarantee that a diagnostic service will identify the underlying cause of every vehicle problem.
6. ECU, TCU AND MODULE PROGRAMMING
ECU, TCU and module programming, coding and cloning involve electronic systems that can be sensitive to voltage, communication and hardware conditions.
Before programming or cloning work is carried out, the Vehicle and/or module may be assessed for suitability.
Where reasonably possible, we may take precautions to protect the vehicle and its electronic systems. However, we cannot guarantee that an ECU, TCU or other electronic module will successfully accept programming or cloning.
If a module is already defective, damaged, corrupted or otherwise unsuitable, programming or cloning may be unsuccessful.
We reserve the right to stop work where continuing may reasonably result in damage to the Vehicle or module.
7. ECU REMAPPING AND MECHANICAL COMPONENTS
ECU remapping changes software parameters that may affect engine operation and vehicle performance.
Additional stress may be placed on mechanical and drivetrain components depending on the vehicle and the calibration used.
Potentially affected components may include:

Turbochargers
-
Clutches
-
Dual-mass flywheels
-
Gearboxes
-
Automatic transmissions
-
Injectors
-
Fuel systems
-
Cooling systems
-
Engine components
-
Drivetrain components
Birmingham Remap cannot guarantee that a vehicle's original mechanical components will withstand increased performance or torque.
You are responsible for maintaining your Vehicle in a safe and roadworthy condition.
8. EMISSIONS AND VEHICLE LEGALITY
You are responsible for ensuring that your Vehicle complies with all applicable UK laws, regulations, construction and use requirements, MOT requirements and other applicable requirements.
Certain modifications to emissions-control systems may make a vehicle unsuitable or unlawful for use on public roads.
For example, UK government guidance states that removal of a factory-fitted DPF can result in an MOT failure and can make the vehicle illegal for road use.
We will not knowingly carry out a modification where we believe doing so would breach applicable law.
Where an emissions-related service is requested, the Customer is responsible for informing us of the intended use of the Vehicle, including whether it will be used on public roads, private land, motorsport premises or for another lawful purpose.
Where a modification is not lawful for use on public roads, it must not be used on public roads.
Nothing in these Terms authorises or encourages the use of a vehicle in breach of UK law.
9. CUSTOMER RESPONSIBILITY FOR INSURANCE
You are responsible for informing your vehicle insurer of any modification to your Vehicle where required by your insurance policy or applicable law.
This may include ECU remapping, performance modifications or other software modifications.
Birmingham Remap does not guarantee that a particular modification will be accepted by your insurer.
You should contact your insurer before booking our Services if you are unsure whether the requested modification needs to be disclosed.
10. MOT, DVLA AND ROAD USE
The Customer is responsible for ensuring that the Vehicle remains compliant with applicable requirements for its intended use.
Where a modification requires notification to the DVLA or another authority, the Customer is responsible for making the appropriate notification unless otherwise expressly agreed in writing.
We do not guarantee that a Vehicle will pass an MOT following any modification or service.
An MOT test is carried out independently by an authorised MOT testing facility.
A vehicle may fail an MOT for reasons unrelated to our Services.
In particular, government MOT guidance states that evidence of tampering with a DPF can result in a major fault.
11. EMISSIONS-RELATED SERVICES
We may receive enquiries relating to DPF, EGR, AdBlue, NOx, O2 and other emissions-related systems.
Customers must understand that altering or disabling emissions-control systems can have legal, environmental and MOT implications.
We reserve the right to refuse any requested modification that we believe would breach applicable law.
Our website descriptions of emissions-related services must not be interpreted as confirmation that a modification is lawful for use on public roads.
The Customer is responsible for using the Vehicle only in circumstances where the Vehicle is legally permitted to be used.
12. BOOKINGS AND APPOINTMENTS
Appointments are subject to availability.
Where we provide a mobile service, the Customer must ensure that:

The Vehicle is accessible;
-
The Vehicle is parked safely;
-
There is sufficient space to work safely;
-
The Vehicle has adequate battery voltage where required;
-
The Customer has authority to give us access to and modify the Vehicle;
-
The location is reasonably suitable for the work requested.
We reserve the right to refuse or postpone work where the location is unsafe or unsuitable.
If the Customer is unavailable or the Vehicle is inaccessible at the agreed appointment time, an additional call-out or appointment charge may apply where reasonable and agreed.
13. CANCELLATION AND RESCHEDULING
Customers should contact us as soon as possible if they need to cancel or reschedule an appointment.
Where applicable, consumers have statutory cancellation rights under UK consumer law.
However, there are circumstances where cancellation rights can be affected, including where a service is fully performed following the Customer's express request for the service to begin during the cancellation period and the required acknowledgement has been provided.
For services involving digital content or software, additional statutory requirements may apply where performance begins during the cancellation period.
We will provide any legally required cancellation information and obtain any required consent where applicable.
Nothing in these Terms removes statutory cancellation rights that cannot lawfully be excluded.
14. SERVICES COMMENCED AT THE CUSTOMER'S REQUEST
Where permitted by law, if you expressly request that we begin providing a service before the expiry of a statutory cancellation period, you acknowledge that work may begin before that period has expired.
Where applicable, we will inform you of the legal consequences of requesting early performance, including any effect this may have on your cancellation rights.
15. ORDERS AND ACCEPTANCE
Submitting an order or booking request through our website does not necessarily mean that your order has been accepted.
We reserve the right to decline an order or booking where:

The requested service is unavailable;
-
The Vehicle is unsuitable;
-
The requested modification may be unlawful;
-
The information supplied is inaccurate;
-
We reasonably believe the service may cause damage;
-
There is a technical issue;
-
There has been an obvious pricing or description error; or
-
We otherwise have a legitimate reason not to proceed.
Where payment has already been made and we decline the order, we will arrange an appropriate refund where required.
16. PRICES AND PAYMENT
All prices displayed on our website are subject to change.
The price applicable to your booking will normally be confirmed before work begins.
Unless otherwise stated, any additional work requested by the Customer may incur an additional charge.
We will seek to inform you of additional charges before carrying out additional chargeable work.
Payment must be made using the payment methods we make available.
We reserve the right to require payment before work begins.
17. FIXED-PRICE SERVICES
Where a service is advertised at a fixed price, the fixed price applies only to the service specifically described in the offer.
A fixed-price service does not automatically include:

Mechanical repairs
-
Replacement parts
-
ECU replacement
-
TCU replacement
-
Module replacement
-
Additional diagnostics
-
Recovery
-
Additional programming
-
Repairs required due to pre-existing faults
-
Additional work requested by the Customer
Any additional work will be discussed with the Customer before it is undertaken wherever reasonably possible.
18. PAYMENT DISPUTES AND CHARGEBACKS
If you have a problem with a service or payment, you should contact Birmingham Remap first so that we have a reasonable opportunity to investigate and resolve the matter.
Nothing in this section affects your statutory rights.
We reserve the right to provide relevant transaction records, booking information and service records to a payment provider where reasonably necessary to respond to an alleged unauthorised transaction or chargeback.
19. VEHICLE ACCESS AND AUTHORITY
By requesting our Services, you confirm that:

You are the owner of the Vehicle or have the owner's permission to request the work; and

You have authority to instruct us to perform the requested Services.
You must not ask us to modify a vehicle without the necessary authority.
We may request reasonable evidence of ownership or authority where appropriate.
20. VEHICLE SECURITY AND BACKUPS
Where technically possible, we may retain or create copies of original ECU/module software or other files for the purpose of carrying out the requested work and/or restoring the Vehicle.
However, we cannot guarantee that an original file, software version or backup will always be available.
Where a manufacturer update, previous modification or other circumstance prevents restoration to the exact previous software state, additional work may be required.
21. SOFTWARE AND THIRD-PARTY PRODUCTS
Some vehicle software, tools, equipment, databases or technical resources used in connection with our Services may originate from third parties.
We do not guarantee the continued availability of third-party software, databases or systems.
Third-party software may be subject to separate terms and licensing restrictions.
22. WARRANTIES AND GUARANTEES
Any warranty or guarantee expressly offered by Birmingham Remap will be subject to the specific terms provided at the time of purchase.
Unless expressly stated otherwise, we do not provide a guarantee of:

A particular horsepower figure;
-
A particular torque figure;
-
A particular fuel economy improvement;
-
A particular acceleration time;
-
A particular MOT result;
-
A particular diagnostic result;
-
A particular mechanical lifespan;
-
Compatibility with future manufacturer software updates; or
-
Compatibility with subsequent modifications.
Nothing in these Terms excludes or limits rights or remedies that you have under applicable consumer law.
23. CONSUMER RIGHTS
If you are a consumer, you have legal rights under UK consumer protection legislation.
Services supplied to consumers must be provided with reasonable care and skill and within any applicable legal requirements.
Nothing in these Terms is intended to exclude, restrict or limit any statutory rights that cannot legally be excluded or restricted.
Where applicable, the Consumer Rights Act 2015 and other relevant UK consumer legislation may apply to your purchase.
24. LIABILITY
We will not exclude or limit liability where doing so would be unlawful.
Nothing in these Terms excludes or limits our liability for:

Death or personal injury caused by our negligence;

Fraud or fraudulent misrepresentation;

Breach of statutory rights that cannot legally be excluded;

Any other liability that cannot legally be excluded or limited.
Subject to the above, we will not be responsible for losses that are not reasonably foreseeable or which arise outside the normal scope of the Services.
We will not be responsible for damage or loss caused by:

Pre-existing faults;
-
Incorrect information supplied by the Customer;

Defective or failing vehicle components;
-
Previous modifications;
-
Previous remapping;
-
Manufacturer software updates;
-
Third-party modifications;
-
Vehicle misuse;
-
Failure to maintain the Vehicle;
-
Continued use of a vehicle after warning signs or faults appear; or
-
Circumstances outside our reasonable control,
except where applicable law provides otherwise.
25. MECHANICAL FAILURE FOLLOWING REMAPPING
A remap does not repair mechanical faults.
Where a vehicle subsequently develops a mechanical or electrical fault, the fact that the Vehicle has previously been remapped does not automatically establish that the remap caused the fault.
Each case must be assessed on its individual circumstances.
Where appropriate, Birmingham Remap may recommend independent mechanical inspection or diagnostic testing.

All content on this website, including:

-

Service descriptions;

Website layouts; and

is owned by or licensed to Birmingham Remap unless otherwise stated.

Nothing in these Terms prevents either party from relying on rights or remedies available under applicable law.

These Terms are governed by the laws of England and Wales.
Where you are a consumer, you will also retain any mandatory protections and rights provided to you under the laws applicable to your circumstances.
Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any mandatory consumer rights regarding jurisdiction.
